Landstar Privacy Policy
This Privacy Policy and Agreement ("Privacy Policy")
covers Landstar's treatment of information that you provide through our
websites (collectively, the "Website" or the "Site," as further defined in
section 2, below). This policy does not apply to the practices
of companies that Landstar does not own or control or to individuals whom
Landstar does not employ or manage, including operators of sites you may
link to or from the Website or from which you link to the Website. This
Privacy Policy and Agreement should be read in connection with our Terms
of Use, and the definitions in our Terms of Use are incorporated by
reference in this Privacy Policy.
Please read this Privacy Policy carefully; it creates
legal obligations. By accessing our Website, you are acknowledging that
you have read and understood this Privacy Policy and agree to be legally
bound by it.
In addition, if you register as a user of any of the
features of our Website, during the registration process (and from time to
time as Landstar may require) you will be prompted to click an "I Accept"
button, which further confirms your agreement to be legally bound by this
Privacy Policy.
This Privacy Policy governs each Website that we have
linked to this Policy, including

www.landstaragent.com, and
www.LCAPP.com (collectively, the "Website" or the "Site"). Certain
other websites branded under our trademarks, including
www.landstarcompanystore.com, are operated and managed by third
parties, and the privacy policies of these third parties may differ from
the Policy that governs this Website. Users are advised to refer to the
applicable privacy policies of such third parties.
This Privacy Policy applies only to information you
provide to us online while visiting or using our Site. It does not apply
to information we have obtained offline or through other traditional
means.
We will not share personally identifiable information you
provide via the Website with any third party, other than as disclosed in
this policy. By "personally identifiable information" we mean information
that identifies you, such as your name, mailing address, email address, or
telephone number.
Landstar collects information from users at different
points on our Website and through our software, and uses this information
as follows:
3.1.
Registration. In order to register for services or to obtain
information through the password-protected areas of our Site (the
"Services"), we require that you complete a registration form. This form
asks for contact information, which may include such items as name,
address, email address, telephone number, company name, fax number and
other basic contact information ("Registration Information"). Depending on
the types of Services you request (such as participation in the Landstar
Communication Network), you may be required to provide additional
Registration Information.
3.2.
Agent Communications. In registering under the Website, BCOs
and agents indicate an interest in exchanging information. To allow such
communications, we provide requisite information, including your contact
information (which includes personally identifiable information) to agents
and/or BCOs. Landstar will provide Website users with access to Load
Information and other related information you choose to post on
password-protected portions of the Site, including the LandstarOnline
site.
3.3.
Other Information Exchanges. In addition to information
exchanges between agents and BCOs, the Website may allow users (i) to
provide and receive a range of information, such as load information, (ii)
to conduct or arrange for transactions, (ii) to provide information in
order to participate in the Landstar Communication Network, and (iv) to
engage in other activity through the Website that may require personally
identifiable information. In these instances, we use the information you
provide to us for the purposes for which you submit the information.
3.4.
Location Information. In making inquiries concerning loads, a
BCO may provide information concerning the BCO's current geographical
location. To process this inquiry, Landstar will use such location
information.
3.5.
Landstar Software. While processing requests and other
transactions at the Website, Landstar software may record general
statistical and tracking information, such as the date and time a BCO
accesses the BCO's account, and the time spent using the account. The
Landstar software transfers this information to Landstar's servers, and
such information is used strictly and exclusively for internal resource
management purposes, and for internal business evaluation purposes.
3.6.
Informational Notices and Bulletins. Periodically, we may
choose to send news, bulletins, marketing materials, or other information
to our Website users, and will use personally identifiable information to
send such communications. If we choose to undertake such communications,
you will have the ability to opt out of receiving these communications as
provided in Section 5.
3.7.
IP Addresses; Other. Landstar may automatically receive and
record information in our server logs from your browser, including your IP
address (the Internet address of your PC), your computer's name, the type
and version of your web browser, referrer addresses and other
generally-accepted log information. We may also record page views (hit
counts) and other general statistical and tracking information, which will
be aggregated with that of other users in order to understand how our
Website is being used.
3.8.
Cookies. A cookie is a small amount of data, which often
includes an anonymous unique identifier, which is sent to your browser
from a website's computers and stored on your computer's hard drive.
Cookies can be used to provide you with a tailored user experience and to
make it easier for you to use the Website upon a future visit. Landstar
will retain cookies that are set on our Website and will use them to
recognize you when you return to our Website. You may set your browser so
that it does not accept cookies. Please review our FAQs for information
as to browser settings and enabling cookies. Cookies must be enabled on
your web browser, if you wish to access LandstarOnline applications.
3.9.
Computer Configuration: In order to determine whether your
computer is supported by our system, we may collect certain anonymous
information. This information includes, but may not be limited to, your
operating system and browser, as well as the presence of any software that
our Website may require to operation with your computer, or other third
party software on your computer. This information is kept strictly
confidential and is not shared with third parties, except as provided for
in this privacy policy.
Except as provided in this policy, we will not disclose
your personally identifiable information to unaffiliated third parties
without your express consent. There are, however, some limited
circumstances (apart from those set out in Section 3) in which we may need to disclose personally
identifiable information about a user, including, but not limited to, the
circumstances set forth below:
4.2.
Imminent Harm. We may reveal your personally identifiable
information to attorneys, private investigator organizations or law
enforcement agencies if we believe that you are harming or interfering (or
will imminently harm or interfere) with other Landstar users or anyone
else or violating (either intentionally or unintentionally) our Terms of
Use or infringing any of Landstar's legal rights.
4.3.
Legal. Landstar will reveal your personally identifiable
information, to the extent we reasonably believe we are required to do so
by law. If we receive legal process calling for the disclosure of any of
your personally identifiable information we will attempt to notify you via
the email address you supplied during registration within a reasonable
amount of time before we respond to the request, unless such notification
is not permitted.
4.4.
Transfer of Site. Landstar shall be entitled to transfer to a
third party information it collects, including any personally identifiable
information, in connection with a sale of all or substantially all of the
assets of the business entity responsible for the information under this
Policy.
5.1.
Discretionary Account Information. To allow you appropriate
control over your personally identifiable information, you can access your
account (after supplying your user name and password) to change or update
discretionary information (including personally identifiable information)
that you have previously submitted; provided, however, that you may not
change non-discretionary information – which is information that consists
of operating company contract information, except as provided in Section
5.2, below.
5.3.
Opt-Out. If we choose to send to you bulletins, updates, or
other unsolicited communications that are marketing-related materials, we
will provide you with the ability to decline -- or “opt-out of” –
receiving such communications. Instructions for opting-out will be
provided if and when Landstar determines to send you such a
communication. Please understand that you will not be allowed to
"opt–out" of formal notices concerning operation of this Website, and
legal and other related notices concerning your relationship to the Site.
5.4.
Deleting Information. Finally, if you request, we will remove
your name and other personally identifiable information from our
databases. Please understand, however, that it may be impossible to remove
this information completely, due to backups and records of deletions. In
addition, please understand that, if you request deletion of your
information, you will be unable to utilize associated features of the
Website and any services provided through password-protected areas of the
Site.
6.
Security
Our site's password-protected section requires users to
give us unique identifiers such as their user id and password. Landstar
utilizes technologies designed to provide secure transactions related to
sensitive data on the site. Landstar employees (and vendors identified in
Section 4.1, above) are required to acknowledge that they
understand and will abide by our policies with respect to the
confidentiality of personally identifiable information. Moreover, we
provide access to our databases containing personally identifiable
information on a need-to-know basis only.
Accordingly, we have put in place security systems
designed to prevent unauthorized disclosure of information you provide to
us. These systems are structured to deter and prevent hackers and others
from accessing this information. Due to the nature of Internet
communications and evolving technologies, however, we cannot provide, and
disclaim, assurance that the information you provide us will remain free
from loss, misuse, or alteration by third parties who, despite our
efforts, obtain unauthorized access.
The Website is not designed for persons under the age of
eighteen, and Landstar does not knowingly collect, either online or
offline, personally identifiable information from persons under the age of
eighteen. If we learn that a child under 18 has provided us with
personally identifiable information, we will delete this information from
our databases.
From time to time, Landstar may change its Privacy
Policy. If we make any changes regarding disclosure of personally
identifiable information to third parties, we will attempt to contact you
prior to the date the modified policy takes effect. We will also post
notice of the new policy from the privacy link on our Website. Your use of
our Site following any such change constitutes your agreement to follow
and be bound by the Privacy Policy, as changed.
This Privacy Policy must be read in conjunction with (i)
our Terms of Use, and the provisions of our Terms of Use are incorporated
herein, and (ii) any specific contracts you have entered with Landstar
(such contracts are referred to as "Landstar Contracts"). To the extent
the terms of such Landstar Contract conflict with the terms of this
Privacy Policy, the terms of the Landstar Contract will control.
By using our Website, you consent to our collection and
use of information, in accordance with this Privacy Policy. If you do not
agree with some, or all of the terms of this Privacy Policy, please
refrain from registering at the Site, or from visiting our Site.
